This page is dedicated to providing the most up-to-date information on wrongfully terminated probation and temporary employees.  You took at oath of office to serve the American people and its just not right that you were fired for being a new employee!  NTEU will take this fight threw the Court System, Congress and beyond.

3/8/25: The 3 paths for challenging your termination:
 

 

  • On Thursday (2/27), NTEU told you about the institutional grievances NTEU has filed at every agency where we represent probationary and trial employees who were terminated.

  • Finally, in a discussion today with the FDA/Office of Human Capital Management (OHCM) we discussed another option for consideration. If you are a terminated probationary employee that has reason to believe you were wrongly classified as a probationary employee, you may reach out to the “Human Capital Officer” at the Center/Office you worked at to request a reconsideration based on you wrongfully being categorized a probationary employee.  As terminated employees on administrative leave do not have access to FDA computers and the network, you may contact ERIC (FDA Employee Resource and Information Center) at 301-827-3742 and ask for the phone and email to the Human Capitol Officer for your center to file the internal appeal request.

Wrongfully Terminated Probationary Employees

As NTEU continues our fight to stop the firing of thousands of probationary employees and challenge the unlawful terminations that have occurred, we must prepare for the possibility of more removals. In addition to the lawsuits, we will be challenging these removals in other forums including the Merit Systems Protection Board (MSPB) and through grievance and arbitration.

Here is some quick helpful information:

If You are a Probationary or Temporary Employee Who Is Still Employed at Your Agency

  • Obtain and retain paper copies of your:

    • SF-50

    • Leave and earnings statements (last three)

    • Any performance documents including performance appraisals, if you have received them

    • Passwords for your TSP and Employee Personal Page (my EPP)

  • Update your personal contact information at nteu.org including your personal email that you check frequently and your cell phone number

 

If You are a Probationary or Temporary Employee Who Was Terminated

  • To help us fight for you and to get your job back through various legal actions, if you haven’t already, complete this form seeking basic information that should only take about 5 minutes to complete. 

  • If you have questions about unemployment compensation, see here and here.

What has happened over these last few weeks is unprecedented. You are our colleagues, our friends and members of the NTEU family. When one member of the NTEU family is hurting, we all hurt. NTEU must stand strong together, help one another and fight for each other and our future. We must ensure that skilled federal employees—who are civil servants making up the backbone of our country—are respected, protected, and allowed to continue delivering for the American people.

Next Steps

NTEU’s lawsuits on behalf of terminated probationary and temporary employees are a big part of our litigation strategy to fight back against the administration’s unlawful actions. But as we await further decisions from the courts in these cases, we are actively planning our next moves. That includes evaluating potential claims at the Merit Systems Protection Board (MSPB), Office of Special Counsel (OSC), contract grievances, etc.
 
There are pros and cons to each strategy and new information is coming in each day that makes a material difference in choosing one path over another. There are filing deadlines for each of these potential actions, and we are aware of those. We are also aware of the efforts of several law firms to file mass actions on behalf of employees. We are taking the time necessary to devise the best strategy for you and will be reaching out soon with further information.
 
As we are finalizing our strategy, we continue to ask that terminated probationary and temporary employees fill out THIS FORM (if you haven’t already) seeking some basic information. It will only take about 5 minutes to complete.
